And if taking an originalist position, do you think that the writers (and voters) of the 14th Amendment, at a time of vastly expanding US immigration, were somehow thinking "Oh no, we don't mean them"? It just doesn't add up.
this is the thing. are there clauses and provisions in the constitution that require other knowledge to understand? absolutely. but the constitution was first and foremost a *public document* meant for *ordinary people* to be able to read and understand
I always think, when I read about the tortured interpretations of the constitution, “I can read.”
