If by "very high" you mean "100%", then yeah. First of all they weren't adjudicated, so presumption of innocence applies. Second of all, even if they "were" transporting narcotics that are illegal in the US that doesn't carry the death penalty. Third, THEY WEREN'T IN US TERRITORIAL WATERS.
