What entity at what level of government has the power to create states? I also think calling the US a federalist system is highly suspect given the Supremacy and Commerce Clauses. Elections are the exception that seems to prove the rule but we function as a blended unitary-federalist system.

While your broad point is not wrong, per se, state legislative seats are so deeply gerrymandered (remind me why state Senate seats have districts?) that most red states can't get Ds to run in even half the districts because the vote splits are 80-20. It's not just laying around, as you say.

Ah yeah, states famously have no subsidiary levels of government. Counties and municipalities NEVER get preempted by legislatures (sarcasm font). Federalism doesn't arbitrarily stop at the state level, it goes down to rural ambulance districts too.
