Situácia transrodových ľudí už pred novelou ústavy bola v rozpore s Dohovorom o ochrane ľudských práv a základných slobôd. Novela situáciu ešte zhoršila, lebo jej text bol písaný s tým, aby boli zakázané tranzície.
