Eric, thanks! Can't we also call out their skipping ESSENTIAL first steps of defining & building upon a workable theory of meaning itself? That's the great howler to me & what I've tried to do. Some very oversimplified summaries also bearing on my Langdell disdain. Sorry for length-I'm passionate.

Is Rule 8.4 dead these days? At least for officials where Comment 7 tells us it has highest application? For example, if #Alito is viewed as a bar member, would 8.4 permit his unqualified statement in his AARP dissent that no "deportations were then planned to occur"? That dissent really bothers me.
