Specifically, the principle of distinction requires that Hegseth must distinguish between combatants & protected citizens. He didn't do that, declaring them combatants with no basis for doing so. That basis would require something more substantive than the nonsense he worked up after the fact.

There doesn't have to be war for something to be a war crime. All that needs to happen is that the agent in question has violated principles of international humanitarian law. In this case, by declaring them enemy combatants, Hegseth violated the principle of distinction....
