Speed and powerlessness are the game here. Speed allows them to remove people before constitutional safeguards can function, while the feigned powerlessness ("Well, they're now in the hands of another sovereign country. There's nothing we can do.") is designed to render their actions irreversible.

If they get away with it, their end run around the constitution (rapidly disappearing someone to another country and then claiming inability to bring them back) can be employed against anyone, citizen or not.
