Have we ever chopped up an existing state into new states (WV comes to mind)? Seems like this usually happened with land that was part of a territory.

I don’t understand. Justices speaking with non-hostile interviewers is common. Sotomayor has done interviews with Oprah, Colbert, Trevor Noah, Erwin Chemerinsky, Jorge Ramos. So what?

KBJ’s critique was hardly straightforward. Her very opening paragraphs assume the answer (if one district court rules X is unconditional then it is so). Wonder if they thought that when Judge O’Connor was issuing national injunctions

I mean yeah but for many of these examples there are legit legal arguments. Firing prosecutors? Firing an NLRB member? Firing inspectors general? There are very strong legal arguments that these are actions are within the executive power.
