“If you speak out in defense of judicial independence only to protect judges (or justices) who rule the way you want them to, then I respectfully submit that your definition of judicial independence is bollocks.”

Me in today’s “One First” on the Trump administration’s “war” on lower-court judges:
193. The "War" on Judges
Deputy Attorney General Blanche's attack on lower courts is an impressive combination of light on substance; shamelessly hypocritical; and profoundly dangerous. More people should be condemning it.

Will Justice Thomas or Alito have the humility to retire before 2026 and secure Judge Ho’s spot on the Supreme Court? What a world.
Today’s bonus issue of “One First” takes a closer look at Judge Ho’s galling concurring opinion on remand in the A.A.R.P. Alien Enemies Act case—which accused #SCOTUS of showing “disrespect” to the district judge and President Trump by … protecting due process:

Bonus 152: Judge Ho, Due Process, and "Disrespect"
Some thoughts on Judge Ho's rather galling claim that the Supreme Court "disrespect[ed]" the district court and the President in Friday's ruling in the "A.A.R.P. II" Alien Enemies Act case.

Deeply lamentable Court of Criminal Appeals news. Hopefully some good people can run. The terminally lopsided court needs judges with defense experience.
Why Texas Court of Criminal Appeals Judge David Newell won't seek reelection in 2026
Judge David Newell told the Statesman that turnover on the court and the changing judicial system contributed to his decision not to stay on the bench

Relive today’s magic and traverse the distance from Dean Martin to Matching Mole while celebrating Art Neville’s birthday, hearing a new tune or three, and a handful of non-obnoxious (though predictable) seasonal numbers. Unless you consider an electro version of “Pretty Paper to be obnoxious.

The strange days roll on …
After 8 years of consistently weird and unpredictable behavior, outgoing Harris County DA Kim Ogg has suddenly recommended offering LWOP in every pending capital case.

This has got to be the most chaotic thing she's ever done. houstonlanding.org/harris-outgo...

Hooray for the Internet!
The Washington Post reports that Michael Anton and Sebastian Gorka had a falling out over who should receive credit for writing Trump's speeches. This is incorrect. In this thread, I will tell you the real reason why Anton dislikes Gorka. 🧵

Yesterday the CCA said it was ok to have jury trials in a “courtroom” in the same building as the Medina County Jail (located on a dusty road on the outskirts of Hondo). I made a few appearances there around 2007. It is NO PLACE for a jury trial. Opinions here:

Today's "One First" offers some reflections on my exchange with Judge Jones at last Thursday's Federalist Society convention—and what it says about our discourse; left-of-center profs continuing to participate in Fed Soc events; and the future of legal debate:

If Jon Langford and one of his collectives are somewhere playing “Memphis Egypt,” they are the greatest rock and roll band in the world at that moment. Tonight it was the Far Forlorn.
