LinkedIn post by Leah Ward Sears that reads: The myth of a meritocracy. Many organizations take pride in being meritocracies, places where talent, hard work, and results drive advancement. On the surface, this seems like an ideal system—fair, rational, and rewarding the best. But there’s a difficult truth we need to face. If your team, leadership, or industry consistently elevates people from the same race, gender, or background, despite operating in a diverse society, you’re not seeing the outcomes of a meritocracy. You’re likely seeing the effects of a system that feels fair but was built on inherited norms and unequal access. Talent is not exclusive to any one group. Opportunity, however, often is. “Merit” isn’t a fixed, objective measure, it’s a constructed one. And who defines it matters. Often:    •   We mistake cultural familiarity for competence    •   We reward those who “fit in” more easily, not necessarily those who challenge or improve the system     [continued in next] [continued post from Leah Ward Sears] We equate elite credentials with potential, even though access to those credentials has never been distributed equitably When “merit” is defined by the dominant group’s experience, it will naturally favor those who already resemble that group. This is how systems of exclusion are perpetuated, even unintentionally. So what does a meritocracy look like? It’s not just about removing bias in hiring. It’s about reexamining how we measure excellence. It’s about asking whether the metrics we use—billable hours, executive presence, “polish,” or pedigree—are objective, or simply familiar. It’s about understanding that equal treatment in an unequal system only deepens disparities. A real meritocracy:    •   Looks beyond the surface to identify untapped potential    •   Creates pathways, not just filters    •   Sees diversity not as an exception to merit, but as its natural outcome Third part of Leah Ward Sears post: We need to be brave enough to rethink the systems we’ve inherited, and clear-eyed enough to recognize where they fall short. That’s not an attack on high standards. It’s a call to raise them, by ensuring we aren’t just rewarding the most visible talent we think we see, but all the talent that actually exists.

20 Law Firms Face DEI Probe by EEOC Many of the top Am Law 100 firms are named in the EEOC announcement Monday. March 17, 2025 at 03:28 PM Government By ALM Staff The original version of this story was published on The American Lawyer The Equal Employment Opportunity Commission said on Monday that it sent letters to 20 law firms requesting information about their diversity, equity and inclusion-related employment practices. The firms include many of the top Am Law 100 law firms. The list comes after President Donald Trump signed an executive order this month directing that the EEOC review the practices of “representative large, influential, or industry-leading law firms" for their diversity practices. The EEOC said, based on publicly available information, that its letter note "concerns that some firms’ employment practices, including those labeled or framed as DEI, may entail unlawful disparate treatment in terms, conditions, and privileges of employment, or unlawful limiting, segregating, and classifying based on race, sex, or other protected characteristics, in violation of Title VII of the Civil Rights Act of 1964 (Title VII)." Acting Chair Andrea Lucas said in a statement, "The EEOC is prepared to root out discrimination anywhere it may rear its head, including in our nation’s elite law firms." LinkedIn post by Jonathan Pollard: An open letter to the law firm partners who sexually harass and sexually assault their subordinates: Good morning, my fellow colleagues. I understand that some of you have made a habit of using your law firms as your own personal hunting ground. Some of you have an unfortunate tendency to harass, bother, flirt with, proposition, and even outright assault women who work in your law firms as legal assistants, paralegals, law clerks, and associates. I'm sure this happens everywhere. But I think it happens in Florida to an extreme degree. Perhaps it's something in the water (or the culture). Most of you who do this are 50 years old or older. Many of you are 60 and up. You are partners in a relatively large law firm. You are rainmakers. You are prominent attorneys. You are powerful within your firm and within this particular arena of law. And that is why you use your firm as your hunting ground. Being powerful within the walls of your BIGLAW firm -- that has given you a captive audience of younger women. Linked in post continues: These women are not there because they like you, want to be in a relationship with you, or want to sleep with you. They are there for a job. These women are being nice to you because (a) some of them are nice and (b) you are their boss or one of their bosses. They are not being nice / polite / friendly / professional with you because they like you. Again: They are there for a job. You are their boss. This should go without saying, but apparently it needs said: 1. It is inappropriate for you to pursue a romantic or sexual relationship with your subordinates in your BIGLAW firm. 2. It is inappropriate for you to pry into the personal / romantic / sexual lives of the women work work in your BIGLAW firm. 3. It is inappropriate for you to demand / expect / seek "hugs" from the women who work in your BIGLAW firm. 4. It is inappropriate for you to go into your paralegal or legal assistant's office, lean over top of her while she is seated at her desk, have your body all over hers, and completely disregard her personal space. I know: Some of you do this and it gets you off. It is beyond gross. You need to stop. Last part of LinkedIn post: 5. Constantly pressuring your subordinate, female employees to get drinks with you or socialize with you outside of work is inappropriate. 6. When you touch your employees and they don't want you to touch them, that is inappropriate. In fact, your unwanted touching can constitute assault or even sexual assault. It's a no go. 7. Sending sexual text messages with a female subordinate is a clear no go. And then saying delete these messages to protect us both -- again, bad idea. 8. Firing women who refuse to sleep with you or who report you to HR for sexual harassment -- total no go. Apparently, not all of you are smart enough to figure that out. But other forms of retaliation (i.e. unfavorable scheduling, lower compensation, derailing one's career) are just as bad. Lots more coming in this space. JP
