You're claiming a scientific consensus on heritability of IQ, but it doesn't seem as though this is a settled question.
And even if it were, you are still left with the problem of treating whole populations based on averages.

a) the reality is that ethic minority criminals currently serve harsher sentences than whites, for the same crimes
b) the proposed changes are not law, they are sentencing guidelines to broaden the use of pre-sentence reports.

I tried finding it, this was the closest I could get.
It shows that male immigrants have higher employment rates than the native population, but for females it's lower.
This suggests there are barriers to access- skills, quals, cultural, etc.
