It is important for Christians who believe that Jesus was a peaceful, loving, kind middle eastern man who did not hate to stand up and fight for that version of Jesus.

The actual legal theory may be a bit more complex than I presented. It may be that the person cannot effectuate consent or criminal intent and the intoxication is voluntary. But I would present both arguments, as the patient requires the anesthesia for the surgery.

She is correct on the fourth amendment violation. Coming out of anesthesia, someone cannot waive their rights.
They are involuntarily intoxicated. Under anesthesia, a person is not culpable for a crime. So they are not capable of waiving their rights.
