We're trying to figure out the scenario where a driver is overtaking and hits a pedestrian. Wouldn't the car they're overtaking be *stopped* because of the pedestrian?

Are the other drivers driving in a manner such that they cannot safely avoid a car that is traveling 5-10mph slower than they are?
Are they driving too fast or following at an unsafe distance?
Perhaps they should slow down as well if that is the case.
