Respectfully, are you a lawyer? You’re over-reading the elements of the statutes, plus making jury/not guilty arguments. Only probable cause, not guilt beyond a reasonable doubt, is required to charge. The FBI affidavit has that regarding the statutory elements.

1/This one's for my fellow #developers. Let's talk about Entity Framework; if you have the option to use Dotnet Core/EF for your business logic/data layers - including Postgres/MySQL on Linux - you really should take a hard look. EF + Linq gives you an amazing degree of control over your data.
