Minister also overeggs and overinflates the purported existing common law jurisprudence on appropriation of property by impairment. We don’t have a tradition of “regulatory takings” etc — that an American tradition, not ours.

So, too, is this conception of formal equality hostile to the aim of "equitable outcomes for Maori students", as the Treaty clause in the Education Act has today been watered down to.
