Walters also queries where these principles of responsible regulation sit in the hierarchy of other constitutional matters like the Bill of Rights.

Walters rightly asks the minister to explain the genesis of the principles in the bill, given then constitutional character of the regime -- cf rights in our Bill of Rights which is founded on well-accepted commitments in international human rights law.

Minister also overeggs and overinflates the purported existing common law jurisprudence on appropriation of property by impairment. We don’t have a tradition of “regulatory takings” etc — that an American tradition, not ours.

Minister flippantly dismissive of Webb’s fair criticism of the selective incorporation of the rule of law in the principles of responsible regulation.

So, too, is this conception of formal equality hostile to the aim of "equitable outcomes for Maori students", as the Treaty clause in the Education Act has today been watered down to.
