always the problem. draft is nearly finished at 17000 words. then I edit and now its 21,000 words. want to shave but can't figure out what's best given what I need to cover. I think i will save it for another, more general paper--perhaps an online essay.

Reposting my paper because it was not distributed in many SSRN e-journals--maybe it's a weird fit.

in april, Vanda Pharm sued the FDA over its new guidance on off-label promotion. this underscores the need for a better system, like the one I proposed several years ago--at the very least a better disclosure document. compare industry to my approach (mine is one page but LR margins too wide)

Just posted my paper, Off-Label Inducement, to SSRN. It argues for a new (old) tort to hold drug and device manufacturers liable for inducing clinicians to make unsafe off-label uses.

Always a pleasure to return home to Chicago for the Law & Stem Junior Faculty Forum at Northwestern University Pritzker School of Law. Thanks to David Schwartz, Christopher Yoo, & Mark Lemley, as well as Northwestern, University of Pennsylvania Carey Law School, and Stanford Law School.
