And just like that, it’s over. But what a two weeks it was for this special group of students in this year’s Modern Treaties & the Law course in the Yukon. Deep experiential learning, immersed in special spaces and communities. Huge thanks to all involved, including these courageous students.

We are so grateful for the precious time and perspectives our guests share with us, including from senior government officials, and Indigenous lawyers, leaders, and negotiators. Students also got to meet with not one but *two* Chief Justices this week. Growth mindset activated.

Rule number one for a lower power party in negotiation and conflict: coalition building. Don’t stand alone. If Canada stays in bilateral tit-for-tat tariff mode we’re toast. It’s time for a coordinated response with intl trade partners, US states, cities, and everyday American friends.

Of course key is decision-making & public interest factors. Restructuring going on. The original 63b (adverse effects) and 63c (mitigation measures) are now both in 62a. And then original 63a (sust), 63d (s.35) and 63e (climate) are now 63 c, a, and b.

Aaaaand that’s a wrap on the 2024 @UCalgaryLaw Negotiations course. The students crushed it(!) but in the most collaborative & respectful way of course. By the numbers: 3 weeks, 140+ students, 2 campuses, countless simulations, more than 50 practitioners and guests.

Never fails that the -30(!!!) cold snap hits during the UCalgary Law 2L Negotiations downtown. But the students muscled through on an extra special day that included the interactive Blanker Exercise and wonderful guests providing their Indigenous perspectives and wisdom. Now onward to Part 2!

Week 1 of @UCalgaryLaw 2L negations course complete! Off to an excellent start w a wonderful group of 140+ students. And what a way to end this week’s curriculum - a special presentation on mindfulness and the legal profession by esteemed guest Dr Thomas Telfer of UWestern Law. 🙏

This course in Environmental Impact Assessment Law is always a treat to teach, but it has been extra special this fall given the Supreme Court case in the federal IAA. The students have been amazing, rising to every experiential learning challenge!

More limits of federal environmental criminal law power tea leaves emerge from the Federal Court today in relation to plastics-ban litigation. I haven’t followed this one closely but an appeal (as suggested by Minister today) could get interesting.

But before pointing the finger at this federal govt, pause and think through causes of these delays. Is it really primarily this government? Or is it the kicking and screaming delayism that’s rife in the opposition and provincial executive branches?

Canada’s federal environment commissioner @OAG_BVG just released first statutorily required report on implementation of measures to achieve climate change emission mission reduction targets. Quelle surprise. We are off track, partly due to delay in key regs. Same old story.

Good question and sorry for a slow response. I think you mean existing (already issued) decisions? Couple thoughts:
- non binding advisory opinion so no immediate effect
- perhaps unaffected, given de facto doctrine (see para 545 from BCSC free entry mining Gitxaala decision, below)

So timely & wonderful to receive this offprint this morning. A couple days ago was the anniversary of the tragic death of beloved colleague, mentor & friend, Dr. Meinhard Doelle @SchulichLaw. His spirit and influence are alive and well. But so many of us miss him dearly.
