Remember when we had a new rule that medical debt couldn’t go on your credit report - and then Trump canceled it? Good times

To bone up on Speech and Debate clause law, I recently read the 11th Cir.'s ruling on Senator Graham's motion that the S&D clause immunized him from prosecution for the calls to GA to 'find votes' - the scope of the immunity isn't that broad outside of Congress.

They lost on the appointment issue, not her mishandling of the indictment - and they were already well on-notice about the appointment issue based on how the courts treated Habba's invalid appointment. As badly as Hallinan performed here, this was a Bondi failure.

Yes, there's apparently some caselaw to that effect. Not sure how strong it is (the statute says "any reason") but I suppose we will find out if Trump/DOJ tries to get another one.
November 24, 2025 at 7:35 PM
Interesting - thanks. It’s curious that the statute says “for any reason” but caselaw says an invalid indictment isn’t a reason.

The statute appears to allow 6 months (as long as it isn't subject to the last sentence), if it's without prejudice, does the district judge have authority to rule that it's some other timeline?
November 24, 2025 at 5:56 PM
Yeah, agree - just because they can legally try to re-file doesn't mean they can get it
November 24, 2025 at 5:53 PM
Sigh - they can probably revive it (see 18 USC 3288)
November 24, 2025 at 5:42 PM
Oh look, the SECDEF ignoring the Constitution again (this time the Speech and Debate clause)
