I mean I don't like to stan nintendo but this really does reek of "Fuck around" and "Find out". What an idiot, but I also think this is completely silly and leads nowhere for Nintendo other than to try and curb this kind of behavior in the future.

But, at the end of the day, for better or for worse, this is the good ending to this situation. All other roads lead to absolutely horrendous outcomes, and thus, that's my takeaway here. /🧵

In any case, this isn't a defense of Nintendo either, they definitely designed this case so that, had it gone to court, it would have likely been damaging to legal precedent around emulation in general, and I believe this was intentional on their part.

Settlement is not a compulsory legal action. Both parties must agree to it, and Nintendo agreeing to settle here makes a lot less sense if Nintendo is genuinely interested in setting a new legal precedent against Emulation more generally.

It's actually kind of odd to me that they would even accept settling a case like this because I believe that, due to how quickly Tropic Haze was to agree to all of Nintendo's demands and settle, they probably were facing a legal case they had no hope of winning.

Thus, settling out of court was the least damaging decision. Obviously it would have been best if Nintendo just shrugged and continued swimming in their colossal money pit and just left Yuzu alone, but we live in reality and in this reality Nintendo is disgustingly litigious.

No matter how Anti-Piracy you claim to be, pay-walling builds that run a leaked brand new game while the public free build doesn't is a clear indication of intent to profiteer from Piracy, and this legally would have been their undoing, and I think they knew that.

This obviously means a few things, and the first of which is that if this had gone to court, they likely would have lost, which sets a very dangerous precedent, and would set them back financially even more, which is bad all around.

There was an instance quite a while back where they attempted to implement a Nintendo Switch Online replacement service called Raptor Network behind their Early Access builds. Just take a look at their use of language as well, it's pretty damning stuff, honestly.

This looks extremely bad for Yuzu Team legally and frankly, it's also not the first time they've tried/planned to stonewall features behind financial compensation of some sort.

At this time the mainline builds either couldn't or couldn't without compromises or external patching. During this period the emulator's Patreon experienced a significant growth in subscriptions, and I don't think I need to explain to you why this was.

Yuzu was making some $30,000+ a month on their Patreon and were pay-walling Early Access builds that, around the time of Tears of the Kingdom getting leaked on the internet, were updated to become capable of playing the game properly.
