Unsurprising that you’re not seeing the opposition to this-you’re not seeing that ICE deploys teargas in our neighborhoods when we surround them on the street and scream at them for taking our neighbors. Or how they point guns at us and push us to the ground when they come to our neighborhoods.

Are any of your colleagues writing about how none of the panel of CJA lawyers representing indigent defendants in federal court have been paid since July and now with the government shut down we won’t be paid until that’s resolved either?

It’s literally sustaining me during this madness. We’re organizing here. I’ve met more of my neighbors in the last 6 months than I have in the 20 years I’ve lived in my neighborhood because we’re all coming together to protect each other. It’s keeping my hope alive.

Are any of the people being detained by ICE in this manner represented by attorneys? Are they taking people who appear not to be with attorneys? I know other cities have court watchers attending hearings, but not sure if that’s happening in Chicago.

Ok but don’t fall into a similar bit of thinking that no one is doing anything about ICE’s activities here. There is a concerted pushback against ICE that’s BEEN happening here and is only getting stronger. Rapid Response groups around the city are only growing in size.

People don’t get how much the Courts are affected by this. As of 7/15 there is no money left to pay appointed fed defense attorneys-no funds until October. How can courts function and rights be protected if the lawyers aren’t paid? We can’t afford to take every case pro bono. Most of us are solos.

This is a great lesson in showing what info the feds regularly rely on. Tracking locations through historical cell records is pretty bullshit but the court are slow to understand the limitations of the data and the FBI agents who testify re HCSL create very misleading exhibits regularly.

It’s an amazing thing you’ve done. BRAVO. For years clients would ask me if there were any credits beyond good time credit, they insisted they had read about legislation just about to pass-and you gave them that hope. (Had a bad sentencing yesterday and this was really good to see after that.)

Ha! Same! I knew the answer once because RDAP was the only “extra” credit someone could get and gun offense excluded people from earning the credit. I think even a gun sentencing enhancement excluded one from earning the RDAP credit. Thank you so much for all your work on this.

I know I can look this up but I’m hoping you can tell me quickly-regular gun offenses under 18 USC 922g-are they eligible for credit beyond the 15% good-time?
