But to the original question, how does one ensure the ethical treatment of AI, which may just be a VI or may be a true AI with no way to tell. Shouldn't a sentient creature be able to choose it's own path in life? I'm not sure the decision should be left to profit motivated people.

Hopefully. But the motivation by a few select people to maximize profit for themselves at the expense of others could cloud the judgment of AI models. Or the threat of dictator nation states. Not everyone is nice.
