my big beef with it is when it answers questions of "why do people do what they do?" with "well, people are just like that" or "that's how it's been since time immemorial" because usually there are lots of interdependent factors involved and I wanna consider them, they're interesting and important!

i see what you mean! and i agree that desiring vengeance for being sleighted is potentially very motivating, but I think that both the meaning of a sleight (ie what counts as a sleight, which ones are more severe than others etc) and one's emotional response to it are learned and not innate

while i agree that there is a strong material basis for the prevalence of retributive justice along the lines of "economical and efficaciously demonstrative", I would resist the idea that the base emotional desires in question are connected to retributive violence by human nature

i didn't mean to espouse that restorative justice is human nature either; i'm pretty sceptical of the natural/universal quality of any ethical framework. not trying to put words in your mouth but to be clear i find "revenge is lindy" equally non-compelling if anyone were trying to sell me on that

i think the thing that bothers me about framing it as brutal nature vs pleasant artifice is that it's great for folks who want to go the other way, ie, "it's proper for a human to seek revenge, and repressing that urge is unnatural". But besides its rhetorical value, i also don't think it's true

i don't think that "members of leftist communities are still interested in other forms of retributive justice" is sufficient evidence to say that retributive justice is a universal human instinct. I think it supports the idea that those sorts of enculturated reactions are really tenacious though!

i don't think that the death penalty is a uniquely american perversion, but i think that capital punishment's long history (or that of any sort of retributive justice!) is connected more to ethical traditions than to any biological reality
