Yes, I always read the abstracts for the subject-matter digests I subscribe to, and at best I skim the school digests. But my point is that email marketing can work for legal scholarship, too, just not the way schools currently practice it.

There's plenty of evidence that it works in lots of contexts. Nothing special about scholarship to suggest it can't work there. Indeed, the SSRN digests are a form of email marketing, and my impression is they do a pretty good job of exposing/increasing readership of papers.

Sure, but email marketing does work, and it's still among the best channels for ROI when used effectively. I just don't think law schools do it effectively. (Similarly, I think the glossy print mailings would be more effective if they were plain text on letterhead with an ink signature.)

If more frequent, I think something like the ECGI working-paper alerts would work. If less frequent, boring black-and-white text with links would be both less likely to get flagged by spam filters and more likely to be read. (There are some technical sending issues with spam filters, too.)

I have an actual view on that. Universally poorly designed. The flashy graphics both cause them to get flagged as spam and reduce their credibility for their reputational-marketing purpose.
