We have had someone at the Guardian recently confirm they chase the metrics and ignore stories they deem won't get them.

Not exactly - the dispute relates to whether the UK was *complying with free movement law in 2020* - the impact upon those subsequently covered by the withdrawal agreement being indirect. A dispute solely about the withdrawal agreement would have gone initially to arbitration, not the CJEU.
