Asking sensible questions like that won't help....

The Home Office has struggled with organisation and systems approaches for some time. It appears to feel constantly overwhelmed and fire fighting, rather than actually "doing".

Asylum claim used to equal grant of ILR. Changed by the Blair govt to 5 years then application for ILR (rare for this not to be granted, unless criminal convictions). How active the reconsideration would be after 2.5 years - unknown.

The UK has this, too. We won't extradite to a country which has the death penalty without an assurance that it won't be applied in that particular case. Including to the USA.

Articles 2 and 3 don't involve any balance. They are absolute. With some fudging in some areas (medical issues, for example).

I don't know about this particular case at all. It is entirely possible, though, to be granted leave to remain in the UK if there is an Article 2/3 ECHR risk on return even if the risk arises wholly and completely from that person's own abhorrent behaviour. Articles 2/3 are absolute rights. 1/2

But not necessarily much of a lag - I started first sixth in October 2001, was called after that and started second sixth in April 2002, fully qualified at the end of September 2002.

If my Dearly Beloved had said "we are pregnant" I would have become a single soon-to-be-mother. Because he absolutely, definitely, wasn't pregnant. "We are expecting a baby", or "we're going to have a baby in July" or whatever, I'm cool with that. But only one of us was pregnant.

Yes. In the same way as if I'm thrown out of an event for being Muslim. I'm not Muslim, but if I'm thrown out of it on the mistaken basis that I am, it's discrimination on the grounds of religion.
