Judge Brian E. Murphy: ELECTRONIC ORDER - AMENDED PRELIMINARY INJUNCTION: In light of the issues raised during the April 28, 2025 hearing, this Court modifies a portion of its April 18, 2025 preliminary injunction 64 . This modification preserves the status quo as outlined in this Court's preliminary injunction. See Sec. & Exch. Comm'n v. Xia, 2024 WL 3447849, at *6-7 (E.D.N.Y. July 9, 2024) (collecting cases modifying preliminary injunctions pending appeal in order to preserve the status quo). Defendants have represented to this court that that removals from Guantanamo Bay to third countries have been executed by the Department of Defense without the Department of Homeland Security's direction or knowledge, see Dkt 72, and the Court makes no finding on the accuracy of this assignment of responsibility but, in an abundance of caution, ORDERS that, prior to removing, or allowing or permitting another agency to remove, an alien from Guantanamo Bay to a third country, Defendants must comport with the terms of the April 18, 2025 preliminary injunction by providing the due-process guarantees set forth in Dkt. 64 at 46-47. At the April 28, 2025 hearing, the status of the Guantanamo Bay Detention Center was debated. The Court declines to resolve if transportation to this base is a deportation to a third country despite the United States' exercise of jurisdiction and control over the base. Given the position taken by the Government that the deportation from Guantanamo to third countries was not at the direction, behest or control of the Department of Homeland Security, a debated issue to be resolved once preliminary discovery has been conducted, this Court ORDERS that, after taking custody of an alien, Defendants may not cede custody or control in any manner that prevents an alien from receiving the due-process guarantees outlined in the April 18, 2025 preliminary injunction.

In their opposition to the motion to enforce, defendants asserted that "[p]laintiffs' arguments rest on fundamental misunderstandings of the D.C. Circuit's stay order. Plaintiffs suggest that the Court should conduct its own analysis of whether the RIF would interfere with the performance of CFPB statutory duties. But the stay order plainly requires Defendants – not this Court or Plaintiffs – to determine that employees subject to a RIF are unnecessary to the performance of CFPB’s statutory duties. And the agency's Chief Legal Officer submits that he and two other attorneys have made that determination. . . . " Defs.’ Opp. [Dkt. # 121] at 2 (internal citations omitted) (emphasis in original). However, it was the defendants who misunderstood what this Court was doing in response to plaintiffs' motion. It simply scheduled a hearing and froze the situation before employees were discharged and data was lost so that it could determine whether the defendants in fact engaged in the particularized assessment that the Order requires. And to make that determination, there was nothing in the law or in the stay order that required the Court to take the agency's word for it, especially after evidence to the contrary had been proffered. Defendants promptly appealed again. This afternoon, the Court of Appeals ordered, sua sponte, that its "stay order be modified in part to lift the partial stay of paragraph (3) of the preliminary injunction." NTEU v. Vought, No. 25-5091 (D.C. Cir. Apr. 28, 2025), Order [Dkt. # 2113309] at 2. This means that the March 28 ban on any reduction-in-force has been reinstated as originally issued. Under these circumstances, the RIF enjoined by this Court on April 18 cannot go forward at all; the Court of Appeals has ordered that "paragraph (3) of the preliminary injunction under review is now effective pending further order of this court." Oh, the luxury of kitchen crying with no children to see. Today this brought my tears to the surface, to read the pain of Liyanara Sanchez, wife of Frengel Mota, to imagine how my own body would feel coping with this. Today I fight back for them. #JGG

Frengel was sent to the Terrorism Confinement Center (CECOT) in El Salvador, a prison known for its overcrowded and inhumane conditions. I am extremely worried about his health and safety. Neither his attorney nor I have been able to contact him or get any meaningful information about him while he remains detained in this foreign prison. He never should have been sent there. 11. At the time he was deported, Frengel was still in active removal proceedings and had not been ordered removed by a judge. He had an immigration hearing scheduled for March 24, 2025, but was unable to appear because he had already been unlawfully removed from the country. 12. We later obtained copies of his immigration paperwork, including his I-213 form and noticed multiple errors. The documents listed someone else’s last name, referred to him with female pronouns, and used two different A-numbers. These mistakes make me extremely worried about how the government identified him for deportation. 13. As his wife, I am dedicated to Frengel’s best interests and committed to representing him while he is detained in a foreign prison and unable to speak for himself. Frengel and I have been together for seven years. We met in Venezuela and after dating for six months, we got married and have been building our life together since. He has helped raise my son as his own and has been a devoted stepfather and partner. He is a kind, hardworking, and family-oriented man who has always taken care of us and supported our home. We want to continue growing our family together. I continued to support him throughout his detention by ICE by looking for immigration attorneys, attending all his bond proceedings, and constantly emailing and calling him. 14. At that hearing, a Magistrate Judge in the U.S. District Court for the District of Maryland conducted a federal detention hearing under 18 U.S.C. § 3142. The Government alleged that W.M.M. was affiliated with the Venezuelan gang “Tren de Aragua” based on emojis used in W.M.M’s social media feed and a comment left by another individual on a social media post. The Government also alleged that W.M.M. was arrested at a residence where an alleged Tren de Aragua associate was present. W.M.M. strongly denies any connection to TdA. 12. Magistrate Judge Charles Austin ordered W.M.M released from federal criminal custody, finding that the Government had not met its threshold burden under § 3142(f)(2) to show a “serious risk that such person will flee.” The Judge noted that W.M.M. “has no other pending criminal charges and no prior failures to appear when ordered by a court,” and that “[h]is only apparent interaction with a court or criminal charges appears to be this case.”

A.A.R.P. is a citizen of Venezuela who was born in 1987. He made an appointment to present at a port of entry using the CBP One app and presented with his wife and their son at the Paso Del Norte Port of Entry in El Paso, Texas in August 2023. 4. When A.A.R.P. was at Paso Del Norte, CBP officers asked him about his tattoos and whether he had any connection to a gang. A.A.R.P. denied any connection to a gang and explained that all his tattoos he had for personal reasons. A.A.R.P. and his family were released into the United States. They moved to Minnesota. 5. A.A.R.P. and his wife were leaving their home on March 26, 2025 to carpool to work when they noticed officers looking at the names on mailboxes in their apartment complex. ICE officers then followed them and stopped their car and arrested A.A.R.P. 6. In an I-213, ICE has accused A.A.R.P. of having “tattoos and associates that indicate membership in the Tren de Aragua gang.” That statement is the only evidence provided by ICE for its allegation. A.A.R.P. strongly denies any connection to Tren de Aragua. 7. A.A.R.P. has a number of tattoos for personal reasons, including various decorative and religious tattoos, such as a cross and the Virgin Mary. CBP officers asked him specifically about a clock tattoo on his forearm—that clock appears under a tattoo of his son’s face and shows the date and time of his son’s birth. Because A.A.R.P.’s wife had had several miscarriages when they were trying to conceive, their son’s birth was particularly important to A.A.R.P. to commemorate in a tattoo. None of his tattoos are related to Tren de Aragua
