Is Premier Smith and the Alberta government enacting the Notwithstanding Clause as a democratic backstop to a controversial judicial ruling? - No.
Then it is clearly using it to ride roughshod over Albertan's Rights.
The use of the Notwithstanding Clause in this regard is deeply concerning.

3/4 ...that would prevent unelected judges from holding too much power vis-à-vis the interpretation and enforcement of the Charter. By contrast, those opposed thought that the clause could undermine the Charter by letting legislatures ride roughshod over rights.
