Significantly, the court concluded that there is a market for licensing copyrighted works to train AI models, and defendants bear the burden of proof to show that training on copyrighted works without permission does not affect this market.
Important decision from Judge Bibas of CA3, sitting in the District of Delaware, holding that using West Headnotes to train a AI is not fair use, focusing on Warhol and limiting Google v. Oracle to computer code.
