Literally, this is not just an indictment of how bad the Morrison government was at making choices (as the Court strangely hinted at) and how things have marginally improved (it hasn't!!). There is a larger malady that courts must hurry to remedy, rather than shoo everyone to public advocacy.
From the sound of it, the Court has yet again washed its hands off from pursuing the simple radicality of duty of care in the Pabai Pabai v Commonwealth. This is tremendously disappointing but also expected that no Australian institution is ready for a second Mabo moment.
