Today's Skrmetti opinion is devastating to transgender children and families who live in states with cruel laws barring gender affirming care. But it is very important to recognize this opinion does not give private entities, legislatures, or the President carte blanche to discriminate! 1/x

The idea that courts will stop all of this is evidence of the crisis, not a reassurance that it wont arrive
I think part of the reason the NYT (et al.) don't yet see this as a crisis is its wildly erroneous belief that "nearly all intragovernmental government disputes eventually wind up" in federal courts. (1/3) "https://www.nytimes.com/2025/02/13/opinion/trump-constitutional-crisis.html?smid=url-share

Couldn’t agree more
It is vitally important that journalists speak to comparativists who study authoritarian takeovers, like @kimlanelaw.bsky.social, and not just to people whose expertise is in US domestic law and politics.
Please listen to @kimlanelaw.bsky.social explain that while the eank insanity of the past 12 days is new to America, it's familiar in Hungary (and Poland and Turkey) down to every particular. When lawyers are more dangerous than tanks in the street...

‼️ The State Department has REMOVED TQIA+ on their page of recommendations for queer travelers. This page yesterday said "LGBTQIA+" and now just says "LGB".

The federal government is trying to erase trans people from existence.

This cert could explain why the Court refused to consider the Due Process parental rights claims in the gender affirming care case..
SCOTUS just agreed to take a case about whether it violates parents' rights to religious exercise if schools instruct kids on gender and sexuality in ways that conflict with parents' religious convictions. (Mahmoud v. Taylor)

Important point of clarification from Chase Strangio: there is a history of de jure discrimination against transgender people, in terms of exclusions from the military, criminal bans on cross dressing, and other laws. (Don't forget marriage restrictions).
