Perfectly reasonable to not like the outcome, but no one should get their hopes up that the Supreme Court will choose to review this decision.
🧵 on new stinker of a CEQA opinion.
Here's hoping @gavinnewsom.bsky.social, @agrobbonta.oag.ca.gov, @buffywicks.bsky.social, @scottwiener.bsky.social, & leaders of Assembly & Senate housing & nat'l res. committees will join Mayor Gloria's petition for review.

@CSElmendorf: New CEQA opinion nixing (again!) the voters' repeal of a 30' height limit in San Diego is a near-perfect vehicle for CA Supreme Court to jettison the worst of "Old CEQA." Very glad that ...

Nearly the same end result could be achieved entirely without CEQA: the mayor could go stencil “bus only lane” on Sports Arena Blvd tomorrow and convince MTS to slightly increase frequency of one bus route, and this would all be upzoned under SB 79. Or just get that idea added to the SANDAG plan.
Democracy lost to CEQA again.
A San Diego appeals court invalidated voter-approved height limit removal because the environmental report wasn't detailed enough.
Removal was twice approved by voters, but now killed by three judges over documentation.

Court orders reinstatement of 30-foot height limit in San Diego’s Midway District
Appellate court ruling finds that the city of San Diego violated state environmental law and abused its power by putting a 2022 ballot measure before voters without the proper analysis.

This will definitely get the kids off the social media! If only someone had thought before to tell them it might be bad for them…
Assemblymember @bauerkahan.bsky.social’s #AB56 has been signed into law by @governor.ca.gov!
By adding warning labels to social media platforms, AB 56 gives CA a new tool to protect our children.
CA won’t sit and wait for companies to decide to prioritize children’s well-being over profits.

This is imprecise, but I think this might be the map of SB79 upzoning for North Park. Based on major transit stops that include frequent routes with at least some dedicated bus lanes. This is 1/2 mile, so everything within these circles would be 55-foot height limit.

Has anyone made the list of all the bus lines in San Diego with dedicated lanes? Park, ECB, University, the 15 BRT lanes…somewhat weirdly, I’m not sure this will apply to Coaster stations given all the late changes
And there it is! #SB79, Sen. Scott Wiener’s bill to legalize multifamily housing near major public transit stops across California, just passed the state assembly!
We are one vote away from the most significant shift in land-use policy California has ever seen!

This already happened in City of San Diego but no one is talking about it. 🤷🏻♂️ It takes effect August 22 outside the coastal zone
This is a very big deal. Allowing the separate sale of ADUs opens up huge opportunities for starter home ownership in our cities. Great job, San Jose! www.cbsnews.com/sanfrancisco...
San Jose becomes 1st California city to allow ADUs to be sold separately from home
San Jose is now the first city in California to allow an accessory dwelling unit, or ADU, to be sold separately from the property's main home. Kevin Ko reports.

This thread is a common feature of development applications in San Diego: even if a building is not historically designated when a developer wants to demolish and build something new, the city makes them do the whole historical report and process. Seems illegal but no one challenges 🤷🏻♂️
It is not. The city can’t force the developers to do anything prior to submitting the preapp. If the developer submits everything on the checklist they have submitted one and vested regardless of what the city says.

It’ll be interesting to see how this applies in San Diego, specifically on historic designation. But it depends on developers just submitting applications rather than the current practice of asking for pre-submittal review.
Today the CA legislature revealed transformative changes to the housing development approval process that will go into effect as soon as Monday... 🧵⬇️

A post from a while ago: how I would handle resident parking at city lots, with the added benefit of loaning out placards at libraries for those who truly can’t afford it.
Listening to the VOSD podcast with @seanelorivera.bsky.social and @scottmlewis.bsky.social discussing a similar topic regarding city parking lots. It would be cool to charge market rates for impacted lots and sell $50 resident placards for annual unlimited use, with nonresidents paying full price.
Scathing audit of boat parking in Mission Bay, including a bit about how the city is wrongly basing fees on cost of maintaining parking when it could instead be charging more based on value of parking spot: www.sandiego.gov/sites/defaul...

One notable change in the ADU regulations that I believe survived is the new ability to sell ADUs. It will be interesting to see how often that is used.

Just got back from NYC and it was a bit shocking how much cleaner the (admittedly touristy parts of Manhattan and Brooklyn) city is than San Diego. The streets, the parks, the public transportation: far far better maintained than our city.

That San Diego neighborhood that stood up to ICE officers last week is also fighting new housing that could make things affordable for people like the restaurant worker they stormed the streets to defend. www.sfchronicle.com/opinion/arti...
My neighbors stood up to ICE. What they did next shows why California politics makes no sense
I just had a front row seat to the often-infuriating incoherence of California progressive politics over housing and immigration.

I’ll willingly concede this is my own weird niche issue, but all these reforms are still premised on the city attorney’s weird idea that parking meter charges are special and the revenue can only be spent for limited uses. No other city does this!
San Diego City Council just voted 5-2 to approve a major package of parking policy reforms, including:
🅿️ dynamic pricing at meters during special events
🅿️ streamlined creation of new meter zones
🅿️ easier creation of residential parking permit zones
🅿️ charging on Sundays*

New opinion from the Court of Appeal on the parks and library ballot initiative case: the Court agrees the Registrar erred in disqualifying some signatures. BUT it’s not a win, the Court also concludes the San Diego Municipal Code prohibits the initiative from going on a future ballot so it’s moot

I’m getting quotes to replace an AC and furnace with an all-electric heat pump, which qualifies for huge federal IRA tax credits and rebates. I’ve had multiple contractors told me they won’t do the rebate because it’s too much hassle and I should just keep the gas furnace. Seems like a problem.

As the city grapples with a tough budget, it would be interesting (but probably impossible) to add up the cost of all the money spent on consultants for plans that are basically ignored by everyone the minute they are published.

OK i read SB 79 amendments in full. It separates counties with 15+ rail stops. 15+ stops allows homes up to 6/7 stories within 0.5/ 0.25 miles of a station
If under 15 rail stops, its only 4/5 stories 0.5/0.25 mi from a station. Cities can introduce their own plans if its equal in capacity to SB 79

I have a distinct recollection that at the hearing where the City Council passed the NP CPU in 2016, Todd Gloria made a big deal about how fixing this intersection needed to a top priority and done quickly. That obviously never happened. Gonna have to go dig the video up…

These numbers are blowing my mind. I get D3 having a lot of visitors to Balboa Park, but for every one visitor from D4, there are ~31 visitors from D2. That is a huge difference.
So Balboa Park is basically just a park for locals that have quality transit and people coming from our most wealthy beach communities. Good to remember when the free parking defenders claim to be fighting for park access for poor families
