This has always been the issue with deterrence. It relies on perpetrators being rational and having the same priorities as lawmakers. They almost never are, and never have.
I mean, the idea a man who randomly stabs and slashes strangers on a train and apparently asks the police to “kill me” would have been deterred by the death penalty…
