FIRE is currently going to bat for Wax because, according to them, there’s no evidence that she ever engaged in actual discriminatory conduct. meanwhile i took one semester of civil procedure with her and remember like 5-6 specific racist incidents directed at students.

for the most part, 5-4 is in the business of articulating for a popular audience ideas that have already been expressed by academics and other commentators. one of the few areas where i consider us pioneers is being among the first to loudly proclaim that roberts is the worst writer on the court
it is astonishing that john roberts thinks the trump v. us opinion is "well-reasoned." unless "well-reasoned" means "written competently enough fool a dumbass into thinking it is no big deal"
the piece makes it clear that roberts doesn't understand the political atmosphere: he thinks that a well-reasoned opinion in the trump immunity case will win the public over. he doesn't think he's spending political capital at all.
