Kilmar Abrego's lawyers ridicule the govt's claim, after Trump and his cabinet members tarred Abrego repeatedly in the press, that a defense filing was supposedly "incendiary."

"Please. The feigned indignation hardly merits a response," they wrote.

it’s a common occurrence now to see the name of a complete lunatic you hadn’t thought about in a while and learn they’re the head of a federal agency. A year or two ago Pulte was fraternizing with a weird online cult who think there’s a conspiracy against Bed Bath & Beyond stockholders.
Yep, I reported this several weeks ago. William Pulte, a Trump loyalist, is using the FHFA bureaucracy to help Trump gin up fake pretexts for prosecutions of his enemies.

One former IG told me: “From beginning to end, this process is highly irregular."

1. Why did Trump grant Top Secret access to a "low-level loser"
2. Why was it marked Top Secret if it's "flat-out wrong"

This decision is bad enough on the merits. But it also gives the government relief in a case in which it defied the district court at least *twice.* That’s quite a message to send to the government with respect to the costs of its litigation behavior in other cases—or the complete lack thereof.

When people ask me how I am: I expect to lose my job any day now. Masked men are kidnapping people off the streets. The US is involved in a war in the middle east. It rained here for so many days, I forgot what the sun looked like. But other than that, things are great.

I'm not a lawyer, but I do listen to the @strictscrutiny.bsky.social "Through the Govenor" doesn't seem that ambigous to me. Why have a separate insurrection act if the President can just call up the National Guard without consulting with a Govenor?

TRUMP SEPTEMBER 2020:

“We have to go by the laws. We can’t move in the National Guard. I can call insurrection but there’s no reason to ever do that, even in a Portland case. We can’t call in the National Guard unless we’re requested by a governor.”

It's hard to overstate how destructive the reflexive "this is a distraction!" stuff that politicians and commentators and people are always peddling.

Everything is happening all at once. That's how authoritarianism works. If you can't navigate and synthesize this, you're not meeting the moment.

Abrego Garcia could ask for a bail hearing to cross examine the government on this pretty basic discrepancy. Suggests a real rush to charge in order to have a political face-saving way to bring him back. Of course, legally his due process rights were already violated, per the Supreme Court.
Bondi DOJ has a problem.

On left:

DOJ Indictment and Detention Memo allege Abrego Garcia lied to officer by not revealing he was coming from Texas

On right:

DHS Referral Report: "Subject stated he was driving 'three days ago' (11/27/2022) from Houston, TX to Temple Hills, MD (via St Louis, MO)"

The presumption that he is a huge liar does a lot to insulate Trump from questions about whether his various erroneous statements indicate confusion or mental infirmity.

When we add to this the Cato Institute report showing how many migrants sent to El Salvador had in fact entered the country legally, THIS is the top story of the night.

The U.S. is sending people to horrors in foreign prisons. People who have had no due process.

An actual nightmare.
This is catastrophe.
🚨According to litigators, ICE just put a dozen men on a flight (which may have already taken off) to SOUTH SUDAN, a country on the brink of civil war, in direct defiance of a court order requiring ICE to give people an opportunity to raise objections before being sent to a country not their own.

Rule from the OPM would allow the president to fire career civil servants: no appeal or due process. Feds swear an oath to the Constitution, not to a president. This rule turns nonpartisan public servants into political pawns. Comments are open until 5/23

Last week, DHS and Secretary Noem's staff and spokespeople suggested that because Mr. Abrego Garcia had $1,100 in cash on him when arrested outside Home Depot seeking day labor, that was strong evidence that he was a member of MS-13.

I guess that raises a similar question about her $3,000.
